Personal use
Short definition
Personal use (Eigenbedarf) occurs when a landlord requires a property for themselves or close relatives and therefore terminates the lease.
When is a termination for personal use permissible?
It is permissible if a legitimate interest according to § 573 BGB (German Civil Code) exists and is comprehensibly justified.
Who counts as a person for personal use?
In addition to the landlord, close family members can also be taken into consideration.
Practical Context
Personal use is one of the most conflict-prone reasons for terminating a tenancy. Errors in the justification or form often lead to delays in the change of tenants.
Example
An insufficiently justified termination for personal use is contested, which significantly delays the move-out and the re-letting.
